Introduction

Easy Munch Pty Ltd (hereafter referred to as “Air Munch”, “we”, “us”, or “our”) provides an online food ordering platform that connects Merchant with Users to offer food and beverage, distributed via the Air Munch platform (collectively, the “Services”), which Services are accessible through its Android app and iOS app (the “App”). Air Munch also operates a website (www.airmunch.com.au) through which some Services may be available (the “Site”).

Air Munch recognises the importance of privacy and maintaining the confidentiality of personal information. In accordance with the privacy legislation applicable in Australia, this Privacy Policy covers all online products and Services provide via Air Munch platform. This outlines the personal information that Air Munch platform collects, uses or discloses as well as the way in which Air Munch will use, manage and protect your personal information when you utilise Air Munch’s App and Site. By using the App and Site, you agree to and consent to the collections, use and disclosure of personal information by Air Munch as set out in this policy. It is strongly recommended that you carefully read this policy each time you visit or use the App and Site.

Collection of Information

Your privacy is important to Air Munch and Air Munch have taken steps to ensure that we do not collect more information from you than is necessary for us to provide you with our Services and products as well as to protect your account.

Air Munch need to collect information about you in order for us to deliver our Services and products. Air Munch may collect personal information (“Information”) from you including you first, middle and last name, address, telephone and mobile numbers, email address, payment details (credit card, debit card or all other payment methods) and other personal information that we collect in the course of a transaction or that you provide us when you contact Air Munch. This will generally occur when you either:

• Register or subscribe to our Services;

• Visit or use our App and Site;

• Complete a transaction with us;

• Post, submit or provide feedback or queries to us;

• Complete a survey;

• Apply for a job;

• Place an order for food and beverage through our App and Site.

In a situation that Air Munch collects personal information about you from someone else or other sources, Air Munch will take reasonable steps to advise you.

Use of Personal Information

If you provide any Personal Information to us, you have authorised us to collect, retain and use that Personal Information for the following purposes:

• Verifying your identity and your eligibility to register as a user of the Air Munch platform;

• Processing your registration as a user, providing you with a log-In ID for the App and Site as well as maintaining and managing your registration;

• Providing you with customer service and responding to your queries, comments, feedback, claims, complaints or disputes;

• Providing our Services to you;

• Our marketing research and activities (newsletters and online articles );

• To facilitate communication between users (person who visit or use the App and Site to order the food and beverages online) and Merchants or third parties in relation to the Air Munch platform;

• Processing any online order for food and beverages;

• Determining the number of visitors to our website and conduct reviews of our website;

• Keeping you informed about offers, promotions, articles or other information that you might be interested in;

• Internal management needs;

• Any other purposes you have consented to;

• For coaching and staff training purposes; and

• Any use which is required or authorised by law.

Air Munch platform collects your personal information and transmits that information to Merchants or any other third parties in relation to the Air Munch platform which you wish to order food and beverages from. This information assists and supports the process of the cooking your meals and to verify your credit card, debit card or other type of payments. Air Munch will not store your credit card or other payment details after the order has been fulfilled. However, Air Munch platform may hold your payment details in its payment gateway so that we provide you with an “Easy” shopping experience. 

Once you have decided to complete any online forms, the information that you enter into any of the online forms will be collected and saved by Air Munch. The information that you supply to us is used to assess your requirements and to enable any Merchant or any other third parties in relation to the Air Munch platform to contact you in response to your enquiry.

Disclosure of Personal Information

Air Munch may also disclose and transfer your personal information (whether within or outside jurisdiction of the Air Munch entity that you are contracting with) to various third parties or service providers engaged by us to assist us with providing you with our Services as followings:

• Data entry, database management, promotions, services alerts, products, delivery services, payment services and membership authentication and verification services.

• Any Merchant or any other third parties in relation to the Air Munch platform to enable them to process and complete your food and beverage order;

• Order food using credit or debit card, your details will be passed on to the secure internet payment provider that we use for processing payment;

• If you have provided your express consent to share the information;

• To send you marketing material or articles for goods and services we think might interest you (whether or not related to your application);

• For administration purposes (including but not limited to process your order with Merchant or any other third parties in relation to the Air Munch platform;

• Payment Gateway, Merchant Account, marketing, logistics and any other technology support or service providers inside or outside of Australia; and

• For other purpose including for commercial advantage.

These third parties are under a duty of confidentiality to us and are only permitted to use your personal information in connection with the purposes set under Use of Personal Information and not for their own purposes (including direct or indirect marketing). Besides, Air Munch may need to provide and share some of your personal information with third parties or service providers located outside of Australia, we will do so in accordance with the Australian Privacy Principles.

Air Munch may also store your information in any type of cloud or other kinds of networked or electronic storage. Since electronic and networked storage can be access from various countries via and internet connection, it is not always practicable to know in which country may hold your information. Hence, your information may also be disclosed to these countries other than those mentioned.

It is a condition of your use of Air Munch’s App and Site, that you agree to allow your personal information to be disclosed to these third parties and for them to establish contact or communication with you. If any point in time if you would like your saved personal information to be deleted from our system, please contact us and we will arrange to remove and delete your records and all your personal information from our system or database.

Air Munch have established relationships with other parties and websites to offer you the benefit of products and services which we do not offer. We offer you access to these other parties and their websites either through the use of hyperlinks to these other websites. In some cases, you may be required to submit personal information to register or apply product and services provided by such third parties.

Air Munch may also provide statistical information to third parties, but when we do so, we do not provide personally identifying information without your permission.

Hence, as a user of Air Munch’s App and Site, you will occasionally receive email updates from us about new products, new services, any other articles and posts, newsletter and changes to the website and any other material we deem relevant. You can always unsubscribe and opt out from receiving these messages.

Air Munch may disclose personal information if required to do so by law, court order, or as requested by a governmental or law enforcement authority or in the good faith belief that disclosure is otherwise necessary or advisable unless otherwise prohibited by law or our contractual obligations.

There is certain information we automatically track like most websites, including the URL that you just came from, the browser you are using and your IP address. All these information or data are being used by Air Munch to improve and provide much better quality services and does not include any personally identifying information.

We may need to disclose some of your personal information to organisations outside Australia, for example the third-party online payment solution. Some of these countries may not have the same or substantially similar privacy laws as those set out in this privacy policy and the Australian Privacy Principles. We may not require organisations to which we disclose personal information in those countries to comply with similar privacy laws, and accordingly your personal information may not receive the same protections that it would in Australia. By providing your personal information to us, you consent to Air Munch disclosing your personal information to organisations in those countries. You may request that Air Munch not disclose your personal information to the countries or organisations outside Australia, but if you do so Air Munch may not be able to provide the services or products you have requested from us.

Security Measures and Cookies

Air Munch employs reasonable precautions to prevent unauthorised access to Air Munch’s App and Site, and to ensure the correct use of the information we hold. However, we may be unable to prevent unauthorised access to such information by third parties or inadvertent disclosure of such information during transit. Users acknowledge this risk when communicating with the website. Air Munch has also implemented a set of variety of security measures to maintain the safety of the personal information that is collected and stored.

All user details collected by Air Munch’s App and Site are stored securely at all times and will never be provided to any unauthorised third parties. While being transmitted over the internet, all credit card details are protected using SSL (Secured Socket Layer) encryption.  Credit card details are handled by third party payment gateway. Air Munch will never save your actual credit card details.  We will just save a reference to your card, which is called a token which is provided by the third-party payment gateway. The purpose of this saved token is that for the future card transactions we can give you option to charge the same card you used previously without having to re-enter your details. You will still need to key in your Air Munch password to use this credit card. If you wish this token to be removed at any point of time in the future, please contact us admin@airmunch.com.au.

Air Munch will not in any circumstances be liable to you, or third parties, for loss or damage arising from credit card fraud or identity theft.

Air Munch uses “cookies” to store specific information about you and track your visits to the sites. The use of cookies is an industry standard and many websites use them to provide useful features for you. Cookies in and of themselves do not personally identify you, only your device or computer. A cookie is a small amount of data that is sent to your browser and stored on your device or computer’s hard drive. A cookie can be sent to your device or computer’s hard drive only if you use or access this website using a device or computer. If you do not remove, erase or de-activate the cookie, each time you use the same device or computer to access this App and Site, our web servers will be notified of your visit to the website and in turn we may have knowledge of your visit and the pattern of your usage.

Air Munch from time to time, use “cookies” to store your preferences, record and collect information on how you visit and access our App and Site. We collect information on the website visited by our customers in order to help us to continue improving our services.

Please also note that third party advertiser or ad servers may place a unique cookie on your browser is not subject to this Policy but is subject to their own respective privacy policies.

Right to Access/Correct Personal Information

Under the applicable laws, you have the right of access to personal information held by us and to request correction of the information. If Air Munch no longer needs your personal information for any purposes set out in this policy or required by law, Air Munch considers such steps are reasonable in the circumstances to destroy or remove the information. Air Munch will take reasonable steps to protect the personal information you supply us from misuse, loss and unauthorised access, modification or disclosure.

Complaints Procedure

You can make a complaint about a breach of the Australian Privacy Principles, which include how we handle your personal information, you may contact us at admin@airmunch.com.au. We will respond to your compliant within a reasonable time after it is received. If you are unhappy with our response, you can lodge a complaint with the Australian Communications and Media Authority.

Changes to this Privacy Policy

This Privacy Policy will be revised from time to time, hence any amendments or changes to this Privacy Policy will be communicated by Air Munch posting an amended and restated Privacy Policy on the App and Site. Once posted on App and Site, the new or revised Privacy Policy will be effective immediately. You agree that any information we hold about you (as described in this Privacy Policy and whether or not collected prior to or after the new or revised Privacy Policy became effective) will be governed by the latest version of the Privacy Policy.
